    How do I name a guardian for my children in Massachusetts?+

    You name a guardian for your minor children in your will. This is a legal designation that tells the court who you want to raise your children if both parents pass away. Without it, the court appoints someone, and it may not be the person you would have chosen. If you have young children, this is the single most important reason to get an estate plan in place now.

    Can a trust protect my home from probate?+

    Yes. When you transfer your home into a revocable living trust, it passes to your beneficiaries outside of probate. This means your family avoids the time, cost, and public nature of probate court. You maintain full control of the property during your lifetime. You can sell it, refinance it, or live in it exactly as you do now. If you still have a mortgage on your home, that does not prevent you from placing it in a trust.

    When should I update my estate plan?+

    You should review your estate plan after any major life event, including marriage, divorce, the birth of a child, buying a home, a significant change in assets, or the death of a named beneficiary or executor. Even without a major change, it is good practice to review your plan every three to five years to make sure it still reflects your wishes and accounts for any changes in Massachusetts law.
